- NZ Employment Relations Authority found an employee was in breach of his employment contract.
- A clause in the employment agreement requiring him to "immediately return all property and material in his possession" upon the termination of his employment
- The employee breached the requirement of good faith.
- Failure to return files cost the employer unrecovered costs in lost revenue, human resources and IT.
